1. DEFINITIONS
"We", "us", "our" refers to DJ Drone Limited.
"You", "your", "client" refers to the person or organisation using our services.
"Services" means drone surveying, aerial mapping, photogrammetry, inspections, and related services.
"Deliverables" means the final data, reports, images, or other materials provided as part of our services.
"Site" means the location where drone operations are conducted.
2. USE OF OUR WEBSITE
2.1 Acceptable Use
You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the website.
2.2 Intellectual Property
All content on this website, including text, graphics, logos, images, and software, is the property of DJ Drone Limited and protected by UK and international copyright laws.
You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
2.3 Website Availability
While we strive to ensure the website is available 24/7, we do not guarantee uninterrupted access. We may suspend or withdraw access for maintenance, updates, or unforeseen technical issues.
3. SERVICE PROVISION
3.1 Quotes and Estimates
All quotes are valid for 30 days from the date of issue unless otherwise stated. Quotes are estimates based on information provided by the client and may be subject to change if site conditions differ from those described.
3.2 Acceptance of Services
A contract is formed when:

You accept our written quote, or

You provide written confirmation to proceed, or

We commence work with your verbal or email authorisation
3.3 Service Scope
Services will be provided in accordance with the agreed scope outlined in the quote or project brief. Any additional work outside this scope will be subject to additional charges.
3.4 Client Responsibilities
You are responsible for:

Providing accurate site information, including access details and hazards

Obtaining any necessary permissions from landowners or site managers

Ensuring the site is safe for drone operations
-
Notifying us of any changes to site conditions or access restrictions
3.5 Site Access
If access to the site is denied, delayed, or restricted through no fault of ours, we reserve the right to charge for aborted visits and rescheduling.
4. FLIGHT OPERATIONS
4.1 Regulatory Compliance
All drone operations are conducted in accordance with UK Civil Aviation Authority (CAA) regulations and the Air Navigation Order.
4.2 Weather and Safety
Flights are subject to suitable weather conditions and safety requirements. We reserve the right to postpone or cancel operations if conditions are unsafe.
4.3 Airspace Restrictions
Operations in controlled or restricted airspace require prior authorisation. We will apply for necessary permissions, but flight approval is not guaranteed. Delays caused by airspace restrictions are beyond our control.
4.4 No-Fly Scenarios
We will not conduct operations if:

Weather conditions are unsafe (high winds, heavy rain, poor visibility)

Airspace permissions are denied

Site conditions pose unacceptable safety risks

Equipment malfunctions occur
In such cases, we will reschedule at no additional cost (subject to availability).
5. PRICING & PAYMENTS
5.1 Pricing
All prices are quoted in British Pounds (GBP) and are exclusive of VAT unless otherwise stated.
5.2 Payment Terms
Payment terms will be specified in the quote. Standard terms are:

50% deposit required upon acceptance of quote

Remaining 50% due upon delivery of final deliverables
-
Payment due within 14 days of invoice date
For larger projects, alternative payment schedules may be agreed in writing.
5.3 Late Payment
Late payments may incur interest at a rate of 8% per annum above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
5.4 Cancellation by Client
If you cancel a booking:

More than 7 days before scheduled flight: Full refund minus £50 administrative fee

3-7 days before scheduled flight: 50% refund
-
Less than 3 days before scheduled flight: No refund
Rescheduling within reasonable notice is typically accommodated at no extra charge.
5.5 Cancellation by Us
If we cancel due to weather, equipment failure, or other circumstances beyond our control, you will receive a full refund or the option to reschedule at no additional cost.
6. DELIVERABLES AND DATA
6.1 Delivery Timeframe
Processed data and deliverables are typically provided within 24-48 hours of flight completion, unless otherwise agreed.
6.2 File Formats
Deliverables are provided in industry-standard formats as specified in the quote (e.g., GeoTIFF, LAS, DXF, PDF).
6.3 Data Accuracy
While we strive for the highest accuracy, drone surveying is subject to limitations including:

GPS signal quality
-
Weather and lighting conditions
-
Ground control point placement
-
Processing software constraints
Accuracy specifications (e.g., RTK ±2-3cm) are provided as guidance and are not guaranteed for every data point.
6.4 Data Retention
We retain project data for 12 months after final delivery to accommodate follow-up requests or revisions. After this period, data is securely deleted unless alternative arrangements are agreed.
6.5 Data Ownership
Upon full payment, you own the final deliverables. We retain the right to use anonymized data, images, or project summaries for marketing purposes unless otherwise agreed in writing.
6.6 Intellectual Property
Raw images, flight logs, and processing files remain our intellectual property. You receive a licence to use final deliverables for the agreed project purpose.
7. LIMITATIONS OF LIABILITY
7.1 Service Limitations
Our services are provided for the specific purpose agreed in the quote. We are not liable for:

Decisions made based on survey data

Consequential or indirect losses
-
Loss of profits, revenue, or business opportunities

Costs incurred due to delays outside our control
7.2 Maximum Liability
Our total liability for any claim arising from our services is limited to the amount paid for those specific services, except in cases of death, personal injury, fraud, or gross negligence (which cannot be limited by law).
7.3 Third-Party Use
We are not liable for losses arising from third-party use of deliverables unless we have been notified in writing and have agreed to such use.
7.4 Insurance
We maintain £10 million public liability insurance. Certificates of insurance can be provided upon request.
8. CONFIDENTIALITY
8.1 Client Information
We treat all client information, project details, and data as confidential and will not disclose it to third parties without your consent, except:

To subcontractors or service providers bound by confidentiality obligations

For anonymized marketing purposes (with identifiable information removed)
8.2 Non-Disclosure Agreements
If your project requires additional confidentiality measures, we are happy to sign a mutual Non-Disclosure Agreement (NDA).
9. HEALTH & SAFETY
9.1 Risk Assessments
We conduct thorough risk assessments before every flight and operate in accordance with health and safety regulations.
9.2 Site Hazards
You must inform us of any known site hazards, including:

Overhead power lines or structures

Underground utilities or pipelines
-
Restricted areas or security concerns
-
Wildlife or environmental sensitivities
Failure to disclose hazards may result in flight cancellation and additional charges.
9.3 Public Safety
We will not operate in conditions that pose risk to the public, property, or our personnel.
10. FORCE MAJEURE
We are not liable for delays or failure to perform services due to circumstances beyond our reasonable control, including:

Extreme weather conditions

Natural disasters

Pandemic or public health emergencies

Government restrictions or airspace closures

Equipment failure caused by third-party manufacturers

Acts of terrorism or civil unrest
In such cases, we will reschedule services or provide a full refund.
11. COMPLAINTS AND DISPUTES
11.1 Complaints Procedure
If you are dissatisfied with our services, please contact us within 7 days of delivery. We will investigate and respond within 14 days.
11.2 Dispute Resolution
We aim to resolve all disputes amicably through good-faith negotiation. If resolution cannot be reached, disputes will be governed by the laws of England and Wales, and parties agree to the exclusive jurisdiction of the courts of England and Wales.
12. DATA PROTECTION

13. CHANGES TO THESE TERMS
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our website or services constitutes acceptance of revised Terms.
14. ENTIRE AGREEMENT
These Terms, together with any written quote or agreement, constitute the entire agreement between you and DJ Drone Limited and supersede any prior agreements or understandings.
15. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
